Illinois is a no-fault divorce state, and there are specific requirements for a no-fault divorce in Northbrook and throughout the state. Rather than alleging grounds for divorce, the Illinois Marriage and Dissolution of Marriage Act (IMDMA) requires that the party who files a petition for the dissolution of marriage plead that “irreconcilable differences have caused the irretrievable breakdown of the marriage.” Then, the court must determine that “efforts at reconciliation have failed or that future attempts at reconciliation would be impracticable and not in the best interests of the family.”
How does a court in Northbrook determine that the requirement of irreconcilable differences has been met? The court will presume that this requirement is met if the spouses have been living separately and apart for at least six months.
Under Illinois law, all property in a Northbrook divorce will need to be classified as separate or marital property. Both assets and debts are classified this way, and then all marital assets and debts will be divided between spouses according to equitable distribution. The IMDMA lists equitable distribution factors that the court can consider when determining what a fair distribution of marital assets and debts looks like.
